Auto wreckers: New (EU) directive approved

The legislative decree making numerous changes to EC Directive 2000/53/EC on end-of-life vehicles was implemented last September 27. The implementation of the articles of Directive (EU) 2018/849 brings numerous changes that affect all car dismantlers. The control system hypothesized by the approved decree is based on measuring and certifying the weight of dismantled vehicles entering and leaving the reference sites. In particular we highlight four of the many articles that make up the decree that emphasize and highlight all the aspects mentioned. Art.3) “strengthen the effectiveness and efficiency of tracking and accounting systems for vehicles, end-of-life vehicles and waste resulting from their treatment, with special reference to the obligation to weigh end-of-life vehicles at collection centers” Subparagraph (P) “inserts into Article 6 of Legislative Decree no. 209-03 a new paragraph 3-bis by ii which provides that vehicle manufacturers ensure the best environmental performance and efficiency of contracted collection centers through the verification of the single environmental declaration models (MUD) provided for in Article 11, paragraph 3, and the possession of ISO 9001 and 14001, EMAS or other equivalent quality management system audited and including treatment processes and ii in-house monitoring. The provision,” the explanatory report points out, “aims to empower producers, implementing the specific guiding criterion dictated by Article 14, paragraph 1, letter a), number 3) of the 2018 European delegation law, concerning ii strengthening the effectiveness and efficiency of traceability and accounting systems for vehicles, end-of-life vehicles and waste resulting from their treatment, with particular reference to the obligation of weighing end-of-life vehicles at collection centers.” “Subparagraph (aa), on the other hand, amends ii paragraph 2-bis of Article 7, specifying that facility managers are required to report the actual weight of end-of-life vehicles entering facilities obtained from the weighing system placed at the entrance of the same treatment facility.” “Subparagraph (qq) of paragraph 1 of Article 1 supplements the requirements for the collection center and the end-of-life vehicle treatment facility in Annex I to introduce a requirement for collection centers to have an appropriate weighing system for incoming end-of-life vehicles. The explanatory report stresses that the provision under consideration allows for the implementation of ii delegation criterion recited in number 3) of subparagraph (a) of paragraph 1 of Article 14 of Law 117/2019. Indeed, this criterion calls for“strengthening the effectiveness and efficiency of traceability systems (…)with particular reference to the requirement of weighing end-of-life vehicles at collection centers.” It is clear that this legislation affects us very closely; our weighing, recording and tracking systems fulfill all the requirements related to the implementation of this measure.
